Anticipated Employment Legislation in the 111th Congress
Date: Thursday, February 19, 2009 (8:30 AM - 10:00 AM) 1.5 CE Credits
Dramatic changes in our country’s employment laws are anticipated in the 111th Congress. Lawmakers are poised to pass new legislation that will significantly impact the workplace and expose employers to greater liabilities. From minimum wage increases and expanded FMLA leave, redefining the term “disabled” under the ADA to union organizing, employers will certainly see and feel the changes. Learn about proposed legislation to expand family rights, including the federal Healthy Families Act and the Family Leave Insurance Act. Become familiar with the Employee Free Choice Act which is the top priority for organized labor because it is anticipated to cause significant organizing efforts by the major unions. Consider how the proposed ADA Amendment Act will nullify various Supreme Court decisions and result in expanded rights and coverage to employees not previously covered by the law.
Learn how amendments to the Civil Rights Act could expose employers to unlimited damages under Title VII and ADA cases. The Fair Pay Act could dramatically change the statute of limitations pertaining to pay discrimination claims and the Paycheck Fairness Act would ensure that women earn the same as their male counterparts. Other items such as flex time, OSHA enhancements and maternity and paternity leave will certainly be addressed by Congress as well. Each employer needs to understand this proposed legislation and be prepared for dealing with compliance and risk avoidance. 2009 may very well bring the most significant changes to employment laws that have ever occurred. Don’t be left behind.

New Premium Only Plan Rules & Other Legislative Updates
Thursday, June 25, 2009 (8:30 AM – 10:00 AM) 1.5 CE Credits
With today’s high health care costs all employers are looking for ways to decrease costs. Establishing a premium only plan or cafeteria plan is a “no brainer” because they save both the employer and employees money. Premium only plans and cafeteria plans have been around for a long time. However, the IRS issued new rules effective this year. The new rules require all employers to amend and restate their plan documents plus test their plans each year for discrimination. We will explore the new document requirements and talk about the discrimination rules.
Although IRS has not devoted a lot of enforcement effort in this area, many people think this is about to change. Therefore, it just makes sense to “get your house in order” and make sure you are complying with the new rules. We will go over what has to be in the plan document and how to perform the discrimination testing for premium only plans. The IRS has indicated that noncompliance can disqualify the entire plan. This would mean that all the pre-tax salary deferrals would be invalid so both the employer and employees would lose all the tax advantages. Therefore, if you are sponsoring a cafeteria plan or premium only plan come join us for a discussion on the new IRS rules.
