Barbara J. Zabawa, JD, MPH, University of Wisconsin Law / University of Michigan Barbara is a Clinical Assistant Professor for Univ. of Wisconsin Milwaukee where she teaches health law and compliance, as well as owner of the Center for Health and Wellness Law, LLC, a firm dedicated to improving legal access and compliance for the health and wellness industries.
Wellness programs are designed to encourage and reward healthy behaviors, but the rules for compliance are complicated and constantly changing. If you have or are considering a wellness program, it is imperative you understand the current rulings when considering the use of incentives for your employees and family members. Wellness incentives need to be compliant with both the Americans with Disabilities Act (ADA) and the Genetic Information Non-Discrimination Act (GINA). This learning center class will keep you straight on the 2019 rules for gathering personal health information from employees and covered family members for your wellness program. You will learn about recent cases that apply to real-life situations. You will leave this session knowing how to apply the ADA and GINA wellness program rules, and how to assess the legal risk when considering the use of incentives for health information collection purposes.
